§1 Applicability to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirmation by clicking on the "Checkout" or "PayPal Direct" button
3) Review of the information in the shopping cart
4) Clicking on the "Checkout" button
5) Login to the online shop after registration and entry of the login details (email address and password).
6) Check and correct the information you have entered.
7) Submit your binding order by clicking on the "Place order" or "Buy" button.

Before submitting a binding order, the consumer can return to the website where the customer's details are recorded and correct any input errors by clicking the "Back" button in the Internet browser they are using, or cancel the order process by closing the Internet browser. We will immediately confirm receipt of the order by means of an automatically generated email ("order confirmation"). With this, we accept your offer.

(5) Storage of the contract text for orders placed via our online shop: We will send you the order details and our terms and conditions by email. You can also view the terms and conditions at any time at https://collaviva.de. For security reasons, your order details are no longer accessible via the internet.

§3 Prices, shipping costs, payment, due date

(1) The prices quoted include statutory sales tax and other price components. Any shipping costs will be added.

(2) The consumer has the option of paying in advance or via PayPal.

(3) If the consumer has chosen to pay in advance, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate shipment. Delivery will be made within 2 business days at the latest. In the case of payment in advance, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer, and for all other payment methods, on the day after the contract is concluded. If the end of the delivery period falls on a Saturday, Sunday, or public holiday at the place of delivery, the delivery period ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the sold item shall only pass to the buyer upon delivery of the item, even in the case of mail order purchases.

§5 Retention of title

We retain title to the goods until the purchase price has been paid in full.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

Financed transactions

If you have financed this contract through a loan and you withdraw from the financed contract, you are also no longer bound by the loan agreement if both contracts form an economic unit. This is particularly likely to be the case if we are also your lender or if your lender makes use of our cooperation with regard to the financing. If we have already received the loan when the revocation or return takes effect, your lender will assume our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the revocation or return. The latter does not apply if the present contract concerns the purchase of securities, foreign exchange, derivatives, or precious metals.
If you wish to avoid a contractual commitment as far as possible, you must revoke both contractual declarations separately.
